MEET YOUR HERO ON-LINE COMPETITION
STANDARD TERMS AND CONDITIONS
By entering into the Speedo MEET YOUR HERO on-line competition (the “Competition”) you agree to be bound by the following Terms and Conditions:
1.
The Competition is open to anyone throughout the world (excluding the United States of America). The Competition will be void wherever it is prohibited or restricted by law. The Competition is specifically closed to employees of the Promoter, Pentland Brands plc, any associated companies, their agencies and their immediate families and anyone else connected with the creation and administration of the promotion.
2.
If you are under 18 years old, you must present these terms and conditions to your parent(s) or legal guardian, and we have the right to request that he or she provide certain additional information. If you are under 18 years old, when you click the “I HAVE READ AND AGREE TO THE COMPETITION TERMS AND CONDITIONS” box on the Promoter’s global website at www.speedo.com (the “Website”) you are confirming to the Promoter that you have received your parent’s/guardian’s express consent to do so and that your parent/guardian:
(a)
has read and on your behalf, agrees to be bound by these terms and conditions;
(b)
is not a minor and is entering into these terms and conditions on your behalf and
(c)
understands, agrees and shall be fully responsible for your participation in the Competition.
If your parent or legal guardian does not agree to (or cannot comply) with these Terms and Conditions or he or she does not wish you to enter into the Competition, do not click the “I HAVE READ AND AGREE TO THE COMPETITION TERMS AND CONDITIONS” and do not enter the Competition.
3.
The Competition commences at 18.00 pm on Wednesday, 18 November 2009 and closes at 12.00 pm on Sunday, 6 December 2009. No entry will be accepted either before the opening date or after the closing date.
4.
NO PURCHASE OF ANY SORT IS NECESSARY TO TAKE PART IN THIS COMPETITION.

To enter the Competition, go to the Website Competition page and complete the entry form. You need to answer in twenty (20) words or less “Why I want to meet my hero, Michael Phelps” and submit your entry. You can enter the Competition as many times as you like provided you give a different answer with each entry.
6.
Your answer must not disparage the Promoter, Michael Phelps or any other party affiliated with the promotion or administration of the Competition, nor infringe the intellectual property rights of any third party. This includes the use of third party copyright. Your entry shall not comprise of words which are obscene or vulgar, offensive, abusive, harmful, threatening, libellous, defamatory, invasive of another’s privacy, sexually or racially or ethically or religiously insulting, harassing, profane or otherwise unlawful. The Promoter reserves the right, at its sole discretion, to disqualify any entry which it believes is in breach of this clause.

7.
By submitting your entry, you warrant that the entry was created by you.
8.
The winner will be chosen by our independent judges on 7 December 2009 and notified by 8 December 2009 by email or telephone. The judges’ decision is final and no correspondence shall be entered into regarding the judges’ decision. In the event that the winner cannot be contacted within twenty-four (24) hours of selection, the Promoter reserves the right to select and to continue selecting an alternative winner until the Promoter finds a winner with whom contact is made within 24 hours of selection.
9.
The winner will the Prize which is as follows:
(i)
2 tickets for the winner (+ Guest) to “The British Gas Duel in the Pool” event on 19 December 2009 in Manchester, UK;
(ii) meet Michael Phelps on 20 December 2009 in Manchester, UK;
(iii)
2 Economy class flights to and from Manchester, UK;
(iv)
2 nights accommodation for two (2) sharing (winner and Guest) at the 4 star Midland Hotel in Manchester, UK on 19 and 20 December 2009 (the ‘Prize Period’);
(v)
transfers to and from Manchester Airport to the hotel;
(vi)
a new generation Speedo LZR Racer suit for the winner.
The Prize does not include spending money, food or any other financial contribution by the Promoter other than as stated above.
10.
If the winner is under the age of 16, he/she must be accompanied when travelling and for the duration of the Prize Period by their parent/guardian who will be classified as their Guest for the purposes of the Prize.
11.
The winner and their Guest must each have a valid passport if they reside outside the UK. It is the winner and their Guest’s individual responsibility to obtain any necessary VISA, consent or other travel documents to enable them to legally enter the UK. If the winner is under the age of 18, it is their parent/guardians responsibility to obtain such travel documents for the winner.
12.
The Promoter shall not be responsible for any entry which is lost or damaged in transit, or which cannot be successfully submitted for whatever reason.
13.
By entering this Competition, contestants grant to the Promoter a perpetual, royalty-free, exclusive right and license to use entries for the purposes of marketing, advertising, promotion public relations, distribution and sale worldwide on any medium as the Promoter sees fit, without any payment or acknowledgement to the contestant.
14.
The winner agrees to take part in post-Competition publicity at the Promoter’s reasonable request. By entering the Competition, the winner agrees to the Promoter’s unrestricted use of any post-Competition publicity for the Promoter’s own purposes in all activities including, without limitation, marketing and promotional activities worldwide including use on the Promoter’s websites and social networking platforms.
15.
Details of the winner (name and country only) shall be made available on the Website after 19 December 2009.
16. The Prize may be altered or varied at the Promoter’s sole discretion and substituted with a prize which, in the Promoter’s sole opinion, is a suitable alternative. The Prize is subject to availability. No cash alternative is available and the prize is non-transferable.

17. Information regarding personal data provided in the entry form will be collected stored and processed in a database for the purpose of managing entry into this Competition. Such information will not be used for any other purpose than as stated in these Terms & Conditions or as separately accepted by you. If you have separately agreed to receive communications from the Promoter and/or its affiliates and partners, then your personal data may be used for such purposes, including direct marketing.
18. Participation in the Competition implies authorisation to transfer your personal data to the UK for the purposes of administering of the Competition. All information submitted to the Promoter as part of this Competition will be treated in accordance with the Promoter’s Privacy Policy (insert link to privacy policy here) and will be held and processed in accordance with the requirements of the 1998 Data Protection Act.
19. The Promoter reserves the right to amend these Terms and Conditions and/or cancel the Competition at its sole discretion.
20.
By entering this Competition entrants agree to be bound by these Terms and Conditions. All entry instructions form part of these Terms and Conditions. These Terms and Conditions are subject to English Law. Any dispute stemming from their existence, interpretation or from their execution will be subject to the competence of the English Courts and each party hereby submits to the exclusive jurisdiction of the English courts.
21. The Promoter of this Competition is Speedo International Limited, Ascot Road, Nottingham NG8 5AJ.
