DUEL IN THE POOL ON-LINE COMPETITION

STANDARD TERMS AND CONDITIONS

By entering into the Speedo DUEL IN THE POOL on-line competition (the “Competition”) you agree to be bound by the following Terms and Conditions:

The Competition is open to all UK, Isle of Man and Channel Island residents. The Competition is specifically closed to employees of the Promoter, Pentland Brands plc, any associated companies, their agencies and their immediate families and anyone else connected with the creation and administration of the promotion.

If you are under eighteen (18) years old, you must present these terms and conditions to your parent(s) or legal guardian, and we have the right to request that he or she provide certain additional information. If you are under eighteen (18) years old, when you click the “I HAVE READ AND AGREE TO THE COMPETITION TERMS AND CONDITIONS” box on the Promoter’s global website at www.speedo.com (the “Website”) you are confirming to the Promoter that you have received your parent’s/guardian’s express consent to do so and that your parent/guardian:

has read and on your behalf, agrees to be bound by these terms and conditions;

is not a minor and is entering into these terms and conditions on your behalf; and

understands, agrees and shall be fully responsible for your participation in the Competition.

If your parent or legal guardian does not agree to (or cannot comply) with these Terms and Conditions or he or she does not wish you to enter into the Competition, do not click the “I HAVE READ AND AGREE TO THE COMPETITION TERMS AND CONDITIONS” and do not enter the Competition.

The Competition commences at [INSERT OPENING TIME AND DATE] and closes at 12.00 pm on 14 December 2009. No entry will be accepted either before the opening date or after the closing date.

NO PURCHASE OF ANY SORT IS NECESSARY TO TAKE PART IN THIS COMPETITION.

To enter the Competition, go to the Website Competition page and complete the entry form. You need to finish the following sentence in twenty (20) words or less: ”I would like to attend this event because…” and submit your entry. You can enter the Competition as many times as you like provided you give a different answer with each entry.

By submitting your entry, you warrant that the entry was created by you.

The Winners will be chosen by our panel of independent judges on 16 December 2009 and notified on 16 December 2009 by email. The judges’ decision is final and no correspondence shall be entered into regarding the judges’ decision. In the event that a Winner cannot be contacted within twenty-four (24) hours of selection, the Promoter reserves the right to select and to continue selecting an alternative Winner until the Promoter finds a Winner with whom contact is made within twenty-four (24) hours of selection.

There will be four (4) Grand Prize Winners and one (1) Runner Up. The Prizes are as follows:

Grand Prize: One (1) pair of tickets to “The British Gas Duel in the Pool” event to be held on 18 and 19 December 2009 (the “Prize Period”) in Manchester, UK (the “Event”) for each Grand Prize Winner;

Runner Up Prize: one (1) Speedo voucher worth twenty-five pounds (£25), to be redeemed at any JJB Sports store. The voucher is not to be used in conjunction with any other promotion.

For the avoidance of doubt, the Grand Prize tickets permit entry to the Event for one (1) day only, to be allocated by the Promoter. Please make sure that you are available on both days to avoid disappointment.

The Prize does not include spending money, travel costs, accommodation, food or any other financial contribution by the Promoter other than as stated above.

If the Winner is under the age of sixteen (16), he/she must be accompanied when travelling and for the duration of the Prize Period by their parent/guardian who will be classified as their Guest for the purposes of the Prize.

Your answer must not disparage the Promoter, the Event or any other party affiliated with the promotion or administration of the Competition, nor infringe the intellectual property rights of any third party. This includes the use of third party copyright. Your entry shall not comprise of words which are obscene or vulgar, offensive, abusive, harmful, threatening, libellous, defamatory, invasive of another’s privacy, sexually or racially or ethically or religiously insulting, harassing, profane or otherwise unlawful. The Promoter reserves the right, at its sole discretion, to disqualify any entry which it believes is in breach of this clause.

The Promoter shall not be responsible for any entry which is lost or damaged in transit, or which cannot be successfully submitted for whatever reason.

By entering this Competition, contestants grant to the Promoter a perpetual, royalty-free, exclusive right and license to use entries for the purposes of marketing, advertising, promotion public relations, distribution and sale worldwide on any medium as the Promoter sees fit, without any payment or acknowledgement to the contestant.

The Grand Prize Winners agree to take part in post-Competition publicity at the Promoter’s reasonable request. By entering the Competition, the Winners agree to the Promoter’s unrestricted use of any post-Competition publicity for the Promoter’s own purposes in all activities including, without limitation, marketing and promotional activities worldwide including use on the Promoter’s websites and social networking platforms.

Details of the Grand Prize Winners (names and counties only) shall be made available on the Website after 16 December 2009.

15. The Prizes may be altered or varied at the Promoter’s sole discretion and substituted with prizes which, in the Promoter’s sole opinion, are suitable alternatives. The Prizes are subject to availability. No cash alternative is available and the prizes are non-transferable.

16. Information regarding personal data provided in the entry form will be collected stored and processed in a database for the purpose of managing entry into this Competition. Such information will not be used for any other purpose than as stated in these Terms & Conditions or as separately accepted by you. If you have separately agreed to receive communications from the Promoter and/or its affiliates and partners, then your personal data may be used for such purposes, including direct marketing.

17. All information submitted to the Promoter as part of this Competition will be treated in accordance with the Promoter’s Privacy Policy (insert link to privacy policy here) and will be held and processed in accordance with the requirements of the 1998 Data Protection Act.

18. The Promoter reserves the right to amend these Terms and Conditions and/or cancel the Competition at its sole discretion.

By entering this Competition entrants agree to be bound by these Terms and Conditions. All entry instructions form part of these Terms and Conditions. These Terms and Conditions are subject to English Law. Any dispute stemming from their existence, interpretation or from their execution will be subject to the competence of the English Courts and each party hereby submits to the exclusive jurisdiction of the English courts.
